Terms & conditions

The terms for buying art from Art-Online Gallery. Please read them before you order.

Effective date:

1. About Art-Online Gallery

Art-OnlineGallery.com is operated by Art Online Gallery LLC, trading as Art-Online Gallery, based in Joplin, Missouri, United States. In these terms, “we,” “us” and “our” refer to Art Online Gallery LLC.

We sell original artwork by South African artists to customers in the United States. Most artwork remains with the artist in South Africa until purchased and is shipped internationally to the customer. Art Online Gallery LLC is your seller and your point of contact for orders, delivery, returns and refunds. These terms apply to purchases on this website; purchases through a separate South African website are governed by that website's terms.

Local consultations in Joplin are available by appointment. A consultation does not mean the artwork is physically available at our U.S. location. Please contact us to confirm availability before arranging a visit.

2. Ordering and acceptance

You must be at least 18 years old, or the age of legal majority where you live, and authorized to use the payment method provided. Please provide accurate contact, billing and delivery details.

An automated order acknowledgment confirms that we received your order. We accept the order when we send an acceptance confirmation after checking artwork availability. If payment has already been collected and we cannot accept or fulfill the order, we will notify you and promptly refund the amount paid.

Many artworks are unique. If an artwork becomes unavailable, we will not substitute another artwork without your agreement. We may decline orders where delivery is unsupported or payment cannot be verified.

3. Artwork descriptions

Listings describe the artwork's medium, dimensions, condition and whether framing is included. Dimensions describe the artwork, not shipping packaging, unless expressly stated. Please review any condition notes and ask questions before purchasing.

Photographs aim to represent the artwork accurately, but screens and lighting can affect how colors and textures appear. Minor screen-related differences do not excuse a materially inaccurate description. Certificates of authenticity are included where specified in the listing.

4. Prices and payment

All website prices and payments are in U.S. dollars (USD). The artwork price, applicable sales tax and flat shipping charge are shown before payment. Applicable import duties, import taxes and standard customs clearance charges are covered by us as described in our Shipping & Delivery Policy.

Payments are processed through Stripe using the payment options available at checkout. We may request reasonable verification to help prevent fraud. Do not send full card details by email or messaging.

If a material pricing or listing error is discovered, we will contact you to offer the corrected terms or cancel and promptly refund the order. We will not charge an additional amount without your agreement. Purchasing artwork is not a promise of appreciation or investment returns.

5. Shipping and cancellations

Our Shipping & Delivery Policy forms part of these terms. Processing time and carrier transit time are separate. Review the estimated timing and supported destinations before ordering.

For standard artwork, you may cancel before dispatch for a full refund by contacting us promptly. Once dispatched, the Returns & Refunds Policy applies. If dispatch is delayed beyond the promised period, we will notify you, provide a revised date, and offer cancellation with a full refund. We will obtain consent to delays where required and issue prompt refunds when required consent is not received.

We remain responsible for resolving orders that arrive damaged, are incorrect or are not delivered as agreed. You are not required to obtain a carrier reimbursement before we provide an appropriate remedy.

6. Returns and custom orders

We do not offer change-of-mind returns for standard artwork. Our Returns & Refunds Policy explains remedies for problems with an order and your applicable rights. Please review the dimensions, medium, framing, photographs, and condition notes before ordering, and contact us with any questions. This restriction does not affect remedies for damaged, defective, incorrect or materially misdescribed artwork, orders we cannot fulfill, or any return or cancellation right required by law. Contact us for return instructions if a remedy requires returning an item; we cover necessary return shipping for our error or damage during outbound delivery.

Buying an artwork transfers ownership of the physical piece once payment is complete and delivery occurs. It does not transfer copyright, reproduction, licensing or other intellectual property rights unless expressly agreed in writing with the rights holder. You may not reproduce or commercially use the artwork without the required permission.

Website photographs, text, branding and designs belong to us or their respective rights holders. You may use the website for lawful browsing and purchasing. You must not interfere with its operation, access other customers' accounts, submit fraudulent orders or reuse protected material without permission.

8. Privacy

Our Privacy Policy explains how we handle personal information, including sharing necessary fulfillment information with artists, logistics providers and service providers in the United States and South Africa.

9. Responsibility and disputes

Nothing in these terms excludes liability or limits a remedy that applicable law does not allow us to exclude or limit. In particular, these terms do not remove rights relating to fraud, material misrepresentation, defective goods or other mandatory consumer protections.

Please contact us first if an issue arises so we can try to resolve it. This request does not prevent you from exercising lawful payment-dispute or other legal rights. Missouri law governs these terms to the extent permitted, without depriving you of mandatory protections that apply where you live. We do not require mandatory arbitration or waive your right to bring a claim in a competent court.

10. Changes to these terms

We may update these terms for future orders by posting a revised effective date. The terms in effect when you place an accepted order apply to that order unless we both agree otherwise or a change is required by law.
