2. Information we collect
We collect information you provide when placing an order, creating an account if available, requesting assistance, arranging a consultation, submitting a return or signing up for communications. This may include your name, email, phone number, billing and shipping addresses, order details, preferences and correspondence. Return requests may include photographs of artwork and packaging.
Our website and hosting services may collect technical information such as IP address, browser and device details, access times, visited pages and security logs. Cookies and related technologies may support shopping carts, account sessions and fraud prevention. Optional tracking practices are described in Section 5.
Stripe processes payment information. Depending on the integration, we receive transaction details such as payment status, transaction identifiers, card brand, and limited card information rather than your full card number. Stripe's own data practices are explained at https://stripe.com/privacy.
3. How we use information
We use personal information to process payments; confirm artwork availability; fulfill and track orders; arrange customs clearance; provide consultations and support; handle cancellations, returns and refunds; maintain accounts where offered; prevent fraud; secure and operate the website; maintain business records; and comply with legal obligations.
If you subscribe to marketing messages, we use your contact details for those messages. You can unsubscribe using the link provided or contact us directly. Unsubscribing from marketing does not stop necessary order, refund or security communications.
4. Who receives information
We share information as needed with payment processors such as Stripe; shipping carriers and customs brokers; artists and fulfillment personnel; website hosting and store providers; customer communication providers; and professional advisers. For example, artists or logistics providers in South Africa may need order details and delivery information to package and send your artwork. We limit fulfillment disclosures to information needed for those tasks.
We may disclose information to comply with lawful requests, protect rights, investigate fraud or handle a business transfer, subject to applicable safeguards. Any disclosures to analytics or advertising providers must be described in Section 5. We do not disclose customer information to artists for their independent marketing without permission.
5. Cookies, analytics and advertising
We plan to use Google Ads and Meta Ads to promote our artwork. Google Ads conversion tracking and the Meta Pixel are not currently enabled on this website. If we introduce these tools, we will update this Privacy Policy to explain the information collected, how it is shared with Google and Meta, and the privacy choices available to visitors.
Our pages load typefaces and icons from Google Fonts, a service run by Google. When a page loads, your browser requests those font files directly from Google's servers, so Google receives your IP address and standard browser request information, such as your browser type, device details and the address of the page you are viewing. We use Google Fonts only to display the website. How Google handles that information is explained at https://policies.google.com/privacy.
6. International processing
Information may be processed in the United States, South Africa and other countries where our service providers operate. Privacy laws may differ between countries. Where applicable law requires safeguards for international transfers, we will use the required safeguards. Delivery information may be shared internationally because the artwork ships from South Africa.
7. Retention and security
We generally retain order, payment transaction, and accounting records for seven years after filing the tax return to which they relate, taking applicable tax and legal requirements into account.
We retain routine customer support correspondence for two years after the matter is resolved. Correspondence needed to document a transaction, refund, or dispute may be retained with the related business records.
We retain customer account information while the account remains active. When an account is closed, or deletion is requested, we delete or de-identify information no longer needed, while retaining records required for legal, accounting, or dispute-resolution purposes.
We retain marketing contact information until you unsubscribe or withdraw permission. After you unsubscribe, we may retain a minimal suppression record to ensure that we respect your preference and do not add you back to our marketing lists.
We may retain records longer when necessary to meet legal obligations or resolve outstanding disputes. Information no longer needed is securely deleted or de-identified where practicable.
We use reasonable administrative and technical measures designed to protect personal information, including appropriate access restrictions and secure services. No online system can guarantee absolute security.
8. Your choices and requests
You can contact us to request access to, correction of or deletion of your information, or to ask about our use of it. Depending on your location and which laws apply, you may also have rights to portability, restriction, withdrawal of consent, opt-out of certain processing, or appeal of a denied request. We will handle applicable requests within the required periods and will not discriminate against you for exercising protected rights.
We may need to verify your identity and may retain information where permitted or required by law, such as records needed for taxes or disputes. If an authorized agent makes a request, we may request evidence of authorization. Send requests and any applicable appeal to sales@art-onlinegallery.com.
9. Children and other websites
Our store is intended for adult customers and is not directed to children under 13. We do not knowingly collect personal information from children under 13. Contact us if you believe a child has provided information so we can investigate and take appropriate action.
Links to external websites and payment services are subject to those providers' privacy policies.
10. Changes
We may update this policy and change the effective date. Where required, we will provide additional notice or obtain consent before materially changing how we use previously collected information.
